Is Medical Marijuana Legal?

The California Health and safety code section 11362.5 (Prop 215) allows California residents who have a qualifying medical condition to use cannabis as medicine with a recommendation from a physician. All you have to do is receive a Medical Marijuana Recommendation from a licensed Doctor.

How do you receive a medical marijuana recommendation?

The process is easier than you think. All you have to do is submit medical records that verify your Qualifying Diagnosis.

You’re not required to submit your entire medical record; all you need is a summary of your medical condition with a list of your current medications from an approved provider. Your diagnosis may come from a physician, licensed alternative Health Care Providers such as an Acupuncturist, Doctor of Naturopathy, Podiatrist, Psychologist, etc. Once approved, your Medical Marijuana Recommendation will be valid for 1 year.

How much Marijuana Can You Possess Legally in California?

As of 2010, you are allowed to posses up to 8 ounces of marijuana legally. Although the Compassionate Use Act, allows California residents to possess or grow marijuana according to their medical needs [11362.5 H&S Code], the Senate Bill 420 (Cal. H&S Code 11362.77) limit’s a person to 8 ounces of dried marijuana and 6 mature or 12 immature plants. 

You can only possess more marijuana legally IF your physician issued recommendation indicates more than the minimum amount stated in the Senate Bill 420. Additionally, marijuana stems and leaves aren’t counted towards the dry weight minimum of 8 ounces.

California citizens can legally grow 6 mature or 12 immature marijuana plants.

Dried mature processed flowers of female cannabis plants or the plant conversion is considered when determining suitable amounts of marijuana under the law. In order to prevent the authorities from confiscating your marijuana plants, it is recommended that you place a valid copy of your recommendation close to the plants. You may also want to consider applying for a Medical Marijuana Identification Card (MMIC). 

When transporting Marijuana, make sure you keep it safely in the trunk of your vehicle.

To avoid being stopped by the authorities and charged with marijuana possession, it is recommended that you place your Medical Marijuana in a safe container within the trunk of your car. It is important to remember that it is illegal to give or sell marijuana to anyone including family and friends.

Keep in mind, once you leave California or even the international borders with medical marijuana it is considered illegal. It is also illegal to have marijuana forwarded to you through mail. Most of all, never operate a vehicle after using medical marijuana.

Keep your Medical Marijuana out of children’s reach.

Medical Marijuana should be kept in a safe place out of children’s reach. Also, if you decide to prepare meals with medical cannabis, make sure you properly label it as “medicine”, and keep it in a safe place. Avoid using medical marijuana in the presence of children.

Also, if you have children and your spouse also uses medical marijuana, make sure at least one parent is not medicated in the event there is an emergency.

Marijuana is "fairly" safe!

According to DEA Administrative Law Judge Francis Young Docket No. 86-22. 1988, Medical Marijuana is considered a safe therapeutically active substance. It is not harmful to key organs, such as your kidneys or liver.

Even though there are no known adverse drug interactions with cannabis, you should never mix it with sedatives or alcohol. Never over use cannabis. Cannabis is most effective when you use it moderately. Some doctors recommend that their patients not use cannabis for at least 2 days within a week. You should refrain from using cannabis more than once a day.

Be cautious with edibles!

When marijuana is eaten, it begins to react within 30 to 60 minutes - this depends on whether a person has eaten it with an empty stomach. The climax effect of cannabis when eaten is around 60 to 90 minutes. Depending on the amount taken, the effect of marijuana can last up to 4-6 hours in duration. Make sure you wait an entire 90 minutes before eating edible marijuana, (i.e. a marijuana brownie).

Never drive after consuming Medical Marijuana!

Medical researchers have confirmed that medical marijuana alters a person’s ability to drive straight and can cause one to swerve in and out of lanes.

Medical Marijuana is Restricted in certain places.

Medical Marijuana is not allowed where ever smoking is prohibited by law. For example, near schools, restaurants, airports, etc.
